1. TRADEMARKS

Definition of Trademark

A trade mark is a symbol which allows your products and services to be readily identifiable and distinguishable over those of your competitors.

It may consist of a word or different words, a design (logo), or a combination of those. You can also register a three-dimensional shape, a combination of colours or even a sound.

Your trade mark can also consist of other distinguishable symbols such as your company or trade name or even your domain name.

Protection of Trademark

A registered trade mark protects the symbol which identifies a product or a service.

The speciality principle is being applied: you ask protection for e.g. non-alcoholic beverages, leather or information technology services according to an International Classification which comprises 45 classes. (The Nice Classification)

2. DESIGN

Definition of Design

A design consists in the appearance of the product itself, a three-dimensional creation, or the product decoration, a bi-dimensional creation.

Protection of Design

A design is only protected to the extent that it is new and has an individual character.

It is preferable not to release information about a design before it is filed. But if this has occurred, the designer still benefits from a one-year-grace period to file the design.

3. PATENTS

Definition of Patent

A patent is an official document granted by an official administration and confirming the inventor’s rights on his “invention”. In general, a patent protects a new product or a new method, simple or complex, which solves a technical problem.

Since all patent applications are published, they are a source of technical information that stimulates the development of new technologies and informs about the exploitation rights.

An invention can be situated in all technical areas: physics, (bio)chemistry, agriculture, biology, electronics, mechanics, biotechnology, construction… as well as inventions regarding software and data bases.

A patent confers to its owner the right to forbid third parties to manufacture, offer, commercialize, use, import or store the patented product, the patented method or the product developed by the patented method.

The essence of copyrights is to protect the creators. Thanks to copyrights they can control the different ways in which their creations are being used.
